Terms of Service

Last updated: August 19, 2026

Overview

Welcome to REVIVAL ARMOUR.

The terms "REVIVAL ARMOUR," "we," "us," and "our" refer to REVIVAL ARMOUR. We operate this online store and website, including all related information, content, features, tools, products, and services that we make available to you (collectively, the "Services").

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer and sell our products.

Certain REVIVAL ARMOUR products are produced using a print-on-demand business model. This means that products may be manufactured, printed, packaged, fulfilled, and shipped after an order is placed. We currently use Tapstitch and may use other third-party production, fulfillment, shipping, and service providers to complete customer orders.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you visit, interact with, purchase from, or otherwise use the Services.

These Terms incorporate our:

  • Privacy Policy.
  • Refund and Return Policy.
  • Shipping Policy.
  • Any additional policies or terms displayed on our website or during checkout.

Please read these Terms carefully. They contain important information regarding your legal rights, product purchases, order changes, shipping, intellectual property, warranty disclaimers, and limitations of liability.

By visiting, interacting with, purchasing from, or using the Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

Section 1 — Eligibility, Access, and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, territory, or country of residence.

If you permit a minor dependent to access the Services through a device, account, or payment method that you own or control, you are responsible for supervising that use and for any resulting activity to the extent permitted by applicable law.

To browse our store, create an account, place an order, or use certain features, you may be asked to provide information such as your:

  • Name.
  • Email address.
  • Telephone number.
  • Billing address.
  • Shipping address.
  • Payment information.

You represent that the information you provide is accurate, current, complete, and lawfully provided.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You must notify us promptly if you believe your account or payment information has been accessed or used without authorization.

You may not transfer, sell, assign, share, or license your customer account to another person without our permission.

We may refuse access to the Services, suspend an account, or close an account where reasonably necessary to protect customers, prevent fraud, enforce these Terms, or comply with applicable law.

Section 2 — Products and Print-on-Demand Fulfillment

Certain products offered by REVIVAL ARMOUR are made to order.

When you purchase a print-on-demand product, the product may not already exist as a finished item at the time your order is placed. Instead, your order may be transmitted to Tapstitch or another production partner for manufacturing, printing, packaging, fulfillment, and shipping.

This production process allows us to offer products without maintaining traditional inventory, but it can also affect:

  • Production times.
  • Order-change availability.
  • Cancellation availability.
  • Shipping origin.
  • Delivery estimates.
  • Return and exchange eligibility.

Products may be produced or shipped from a facility located in a different state, country, or region from REVIVAL ARMOUR or from the delivery address.

The use of a third-party fulfillment provider does not change the fact that your retail purchase is made from REVIVAL ARMOUR.

Questions, concerns, cancellation requests, refund requests, and customer-service inquiries relating to your purchase should be directed to REVIVAL ARMOUR rather than directly to Tapstitch unless we specifically instruct you otherwise.

We reserve the right to:

  • Limit product quantities.
  • Discontinue a product.
  • Change available product colors or sizes.
  • Decline sales in certain geographic locations.
  • Remove a product from our store.
  • Substitute a substantially equivalent production method where appropriate and lawful.

Any substitution affecting a material product characteristic will be handled in accordance with applicable law.

Section 3 — Product Descriptions, Images, Colors, and Sizing

We make reasonable efforts to describe and display our products accurately.

However, the appearance of colors, textures, prints, and other product details may vary depending on:

  • Your device.
  • Screen calibration.
  • Browser settings.
  • Lighting.
  • Fabric type.
  • Garment size.
  • Manufacturing process.
  • Printing method.

Product mockups may be digital representations of the final product rather than photographs of the exact individual item that you will receive.

Because garments are manufactured and printed individually, minor variations may occur in:

  • Color tone.
  • Print placement.
  • Print dimensions.
  • Fabric texture.
  • Stitching.
  • Garment measurements.

Reasonable production variations that do not materially affect the product's quality, function, or conformity may not constitute a manufacturing defect.

This does not limit any rights you may have when a product is defective, damaged, materially different from its description, incorrectly fulfilled, or otherwise nonconforming under applicable law.

Size Information

Customers are responsible for reviewing the applicable size chart before placing an order.

Sizing can vary between product styles, garment types, manufacturers, and regions. A size selected for one product may not have the same measurements as the same labeled size for another product.

Please compare the measurements in the product's size chart with a garment that fits you before purchasing.

Return or exchange eligibility for sizing issues is governed by our Refund and Return Policy and applicable law.

Care Instructions

You should follow the care instructions supplied with the product or displayed on the product page.

Damage caused by improper washing, drying, ironing, bleaching, alteration, misuse, or failure to follow care instructions may not qualify as a manufacturing defect.

Section 4 — Orders and Acceptance

When you submit an order, you are making an offer to purchase the selected products under these Terms.

Receiving an order confirmation does not necessarily mean that we have finally accepted the order. It confirms that we have received your order request.

An order is accepted when we confirm acceptance, begin fulfillment, or ship the product, depending on the circumstances and applicable law.

We reserve the right to refuse, limit, hold, or cancel an order for legitimate reasons, including:

  • Product unavailability.
  • Pricing or listing errors.
  • Suspected fraud.
  • Unauthorized payment use.
  • Payment failure.
  • Address problems.
  • Order duplication.
  • Unusually large quantities.
  • Resale activity.
  • Previous payment disputes.
  • Violation of these Terms.
  • Legal or regulatory restrictions.

If we cancel an order after receiving payment and no acceptable substitute or resolution is agreed upon, we will issue an appropriate refund to the original payment method.

We may contact you using the email address, billing address, shipping address, or telephone number supplied with the order.

You represent that purchases are made for legitimate personal or household purposes and not for unauthorized resale, export, fraud, or other unlawful activity.

Section 5 — Reviewing Your Order

You are responsible for reviewing your order carefully before submitting it.

Before placing an order, verify:

  • Product design.
  • Product style.
  • Size.
  • Color.
  • Quantity.
  • Billing information.
  • Shipping address.
  • Email address.
  • Telephone number.
  • Shipping method.

Because print-on-demand products may enter production shortly after purchase, errors may become impossible to correct after the order is submitted.

REVIVAL ARMOUR is not responsible for information entered incorrectly by a customer to the extent permitted by applicable law. We will nevertheless make reasonable efforts to help when contacted promptly.

Section 6 — Order Changes and Cancellations

Contact us immediately at revivalarmour@gmail.com if you need to request an order change or cancellation.

A request is not approved merely because it has been submitted.

Because made-to-order products may enter production quickly, we cannot guarantee that we will be able to:

  • Cancel an order.
  • Change a size.
  • Change a color.
  • Change the product.
  • Change the design.
  • Change the quantity.
  • Change the delivery method.
  • Change a shipping address.

Once production has started, product changes and cancellations may no longer be possible.

If an eligible order has not entered production, we may attempt to cancel it so that a corrected order can be placed.

If we successfully approve and process a cancellation, any applicable refund will generally be sent to the original payment method. The time required for the refund to appear depends on the payment provider and financial institution.

A shipping-address change is not guaranteed. Address changes generally become unavailable after an order has shipped.

If a customer provides an incorrect or incomplete address and the order cannot be delivered, additional production or shipping charges may apply before the order can be resent.

Nothing in this section limits a cancellation, withdrawal, refund, or other right that cannot legally be waived.

Section 7 — Prices, Billing, Taxes, and Promotions

Prices, discounts, product availability, and promotions may change without notice.

The product price charged will generally be the price displayed when the order is submitted and shown in the order confirmation, subject to correction of obvious errors and applicable law.

Unless otherwise stated, listed product prices may not include:

  • Shipping.
  • Handling.
  • Sales tax.
  • Value-added tax.
  • Customs duties.
  • Import fees.
  • Other government charges.

Applicable charges that we collect will be displayed during checkout where required and reasonably possible.

You agree to provide current, complete, and accurate billing, payment, purchase, and account information.

You represent that:

  • You are authorized to use the payment method submitted.
  • The payment information is accurate.
  • The payment provider is authorized to process the transaction.
  • You will pay all charges associated with an accepted order.

Promotions and Discount Codes

Promotions and discount codes may be subject to separate conditions, including:

  • Eligibility restrictions.
  • Minimum purchase amounts.
  • Product exclusions.
  • Geographic restrictions.
  • Usage limits.
  • Expiration dates.
  • One-use-per-customer limitations.

Unless expressly stated otherwise, promotions:

  • Cannot be combined.
  • Cannot be redeemed for cash.
  • Cannot be applied retroactively.
  • May be modified or ended where permitted by law.

We may cancel or refuse discounts obtained through fraud, manipulation, multiple-account abuse, automated systems, or violation of promotion terms.

Section 8 — Production, Shipping, and Delivery

Processing time and shipping time are separate.

Processing or production time is the time required to prepare, manufacture, print, inspect, and package an order.

Shipping time is the time between the carrier receiving the package and attempted delivery.

Delivery dates and timeframes displayed on our website, during checkout, in emails, or through tracking systems are estimates unless we expressly state that a date is guaranteed.

Delivery estimates may be affected by:

  • Product availability.
  • Production volume.
  • Quality-control reviews.
  • Carrier delays.
  • Weather.
  • Natural disasters.
  • Labor disruptions.
  • Customs processing.
  • Government actions.
  • Security inspections.
  • Address errors.
  • Holiday periods.
  • Events outside our reasonable control.

Orders containing multiple products may be produced or shipped separately and may arrive in more than one package.

We will provide available tracking information when applicable.

You are responsible for monitoring tracking information and making reasonable arrangements to receive the package.

We are not responsible for delays caused solely by incorrect or incomplete shipping information supplied by the customer.

If an order is delayed materially after purchase, we will provide notice where required by applicable law.

Risk of loss and ownership of products will transfer at the time required under applicable law. Nothing in these Terms transfers risk to a customer earlier than permitted by law.

Section 9 — International Orders, Customs, and Import Charges

Some products may be produced or shipped internationally.

International orders may be subject to:

  • Customs clearance.
  • Duties.
  • Taxes.
  • Import charges.
  • Brokerage fees.
  • Government processing fees.
  • Additional delivery delays.

Where these amounts are not collected during checkout, the recipient may be responsible for paying them to the extent permitted by applicable law.

REVIVAL ARMOUR does not control charges imposed directly by customs authorities, governments, carriers, or other third parties.

Customers are responsible for determining whether a product can lawfully be imported into the destination country.

We may decline or cancel an order when legal restrictions, shipping limitations, sanctions, carrier restrictions, or customs requirements prevent fulfillment.

If we cancel an order because it cannot lawfully or practically be fulfilled, we will issue an appropriate refund, excluding amounts we are legally entitled to retain.

Section 10 — Returns, Refunds, Replacements, and Exchanges

Returns, refunds, replacements, and exchanges are governed by our Refund and Return Policy, which is available through our website and is incorporated into these Terms.

Because certain REVIVAL ARMOUR products are made specifically after an order is submitted, change-of-mind returns or exchanges may be limited as described in our Refund and Return Policy.

However, these limitations do not remove rights that cannot legally be waived, including applicable rights relating to defective, damaged, misdescribed, incorrectly fulfilled, or nonconforming products.

Damaged, Defective, Misprinted, or Incorrect Products

Please inspect your order promptly after delivery.

Contact revivalarmour@gmail.com as soon as reasonably possible if an item is:

  • Damaged.
  • Defective.
  • Misprinted.
  • Incorrect.
  • Missing.
  • Materially different from the product ordered.

To help us investigate, we may request:

  • Your order number.
  • A description of the problem.
  • Photographs or videos of the item.
  • Photographs of the packaging.
  • Photographs of the shipping label.
  • Other information reasonably necessary to verify the issue.

Providing this information does not automatically guarantee a refund or replacement, but it may be necessary to investigate and resolve the claim.

Return Authorization

Do not return a product to Tapstitch, the address printed on a package, or another third party unless REVIVAL ARMOUR has provided return instructions.

Returns sent without authorization or sent to an incorrect address may not be accepted or recoverable.

If a return is approved, we will provide instructions and, where applicable, the correct return address.

Refund Processing

Approved refunds will generally be sent to the original payment method and in the original purchase currency.

After we issue a refund, additional processing time may be required by your bank, credit-card company, payment provider, or financial institution.

Section 11 — Lost, Missing, and Marked-Delivered Packages

Contact us promptly if tracking information shows that an order is delayed, lost, or delivered but you cannot locate it.

Before contacting us about an order marked delivered, please:

  • Check the delivery location.
  • Check with household members.
  • Check with neighbors where appropriate.
  • Check with building management.
  • Review the carrier's tracking information.
  • Contact the carrier if instructed.

We may open an investigation with the carrier or fulfillment provider.

A package being marked delivered does not automatically determine every claim. We will evaluate the available tracking information, delivery evidence, circumstances, our policies, and applicable law.

Replacement or refund eligibility for missing packages is governed by our Refund and Return Policy and applicable law.

Section 12 — Product Safety and Recalls

You should use products according to their intended purpose and follow applicable care labels, warnings, and instructions.

Stop using a product and contact us if you believe it presents a safety risk.

If a product is subject to a safety notice, correction, or recall, we may:

  • Remove it from our store.
  • Contact affected customers.
  • Request that customers stop using it.
  • Provide return, disposal, replacement, or refund instructions.
  • Take other action required by law.

You agree to keep your account and contact information reasonably current so we can contact you about an affected order where necessary.

Section 13 — Intellectual Property

The Services and their original content—including REVIVAL ARMOUR branding, original artwork, graphics, photographs, product descriptions, videos, audio, layouts, designs, and site organization—are owned by or licensed to REVIVAL ARMOUR and are protected by applicable intellectual-property laws.

This ownership claim does not apply to third-party trademarks, licensed materials, or public-domain materials that may appear through the Services. Those materials remain subject to the rights of their respective owners.

These Terms grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal, non-commercial shopping purposes.

Without prior written permission, you may not:

  • Reproduce our protected content.
  • Distribute our protected content.
  • Sell or license our protected content.
  • Modify or create unauthorized derivative works.
  • Download or store substantial portions of the Services.
  • Copy product photographs or descriptions.
  • Copy, trace, or reproduce original apparel designs.
  • Use our content to train or develop a commercial artificial-intelligence system.
  • Remove copyright, trademark, or ownership notices.
  • Use REVIVAL ARMOUR branding in a way that causes confusion.
  • Suggest an affiliation, sponsorship, or endorsement that does not exist.

The name REVIVAL ARMOUR, our logos, original designs, product names, and slogans may be trademarks or other protected brand assets of REVIVAL ARMOUR or its licensors.

Shopify, Tapstitch, and other third-party names, logos, and marks belong to their respective owners.

Nothing in these Terms transfers ownership of intellectual property to you.

All rights not expressly granted are reserved.

Intellectual-Property Complaints

If you believe material displayed through the Services infringes your intellectual-property rights, contact us at revivalarmour@gmail.com with:

  • Your contact information.
  • Identification of the protected work.
  • Identification of the allegedly infringing material.
  • The location of that material.
  • A statement explaining the basis of your claim.
  • Any supporting documentation reasonably necessary to review the complaint.

Submitting a false or misleading infringement notice may have legal consequences.

Section 14 — Optional Third-Party Tools

We may provide access to tools, applications, payment options, integrations, or services offered by third parties.

We do not necessarily control, monitor, or endorse every third-party tool.

Third-party tools may be provided on an "as is" and "as available" basis and may be governed by separate terms and privacy policies.

Your use of an optional third-party tool is at your discretion and may require you to agree to the third party's terms.

We may introduce new tools, resources, or features in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.

Section 15 — Third-Party Links and Services

The Services may contain links to websites, social-media platforms, content, or services operated by third parties.

We are not responsible for examining or guaranteeing the accuracy, safety, legality, availability, or privacy practices of third-party websites.

Accessing a third-party website is at your own discretion and risk.

Any purchase or transaction made directly through a third-party website is between you and that third party.

Please review the third party's policies before submitting information or completing a transaction.

Questions regarding a third party's products or services should generally be directed to that third party.

Section 16 — Relationship With Shopify

REVIVAL ARMOUR is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are made directly with REVIVAL ARMOUR.

By using the Services, you acknowledge that Shopify is not the seller of REVIVAL ARMOUR products and is not responsible for any aspect of a retail sale between you and REVIVAL ARMOUR, including injury, damage, or loss resulting from a purchased product or service.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising directly from your purchases and transactions with REVIVAL ARMOUR.

Nothing in this section limits liability or rights that cannot legally be waived.

Section 17 — Relationship With Tapstitch and Fulfillment Partners

Tapstitch and any other production or fulfillment partners we use provide manufacturing, printing, fulfillment, logistics, and related services to REVIVAL ARMOUR.

Tapstitch is not the retail seller from whom you purchase REVIVAL ARMOUR products.

Your customer relationship and contract of sale are with REVIVAL ARMOUR unless we clearly state otherwise.

The terms between REVIVAL ARMOUR and Tapstitch do not automatically replace the customer-facing policies between REVIVAL ARMOUR and you.

For customer support, order issues, cancellations, returns, refunds, or replacements, contact REVIVAL ARMOUR at revivalarmour@gmail.com.

We may communicate with Tapstitch, carriers, and other providers on your behalf to investigate or resolve an order issue.

Section 18 — Privacy Policy

Personal information collected through the Services is handled according to our Privacy Policy, which is available through our website.

Because the Services are hosted by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services.

Information needed to process, produce, fulfill, ship, and service an order may also be transmitted to Tapstitch, payment providers, carriers, and other service providers.

Please review our Privacy Policy for more information about how REVIVAL ARMOUR, Shopify, Tapstitch, and other providers may process personal information.

By using the Services, you acknowledge that you have had the opportunity to review the applicable privacy policies.

Section 19 — Reviews, Feedback, and Submissions

If you submit a review, photograph, video, comment, suggestion, idea, feedback, or other content to REVIVAL ARMOUR, you retain any ownership rights you have in that submission.

You grant REVIVAL ARMOUR a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, format, modify for technical or editorial purposes, publish, distribute, display, and otherwise use the submission in connection with:

  • Operating the Services.
  • Customer support.
  • Product improvement.
  • Marketing.
  • Advertising.
  • Promoting REVIVAL ARMOUR.

This license continues for as long as reasonably necessary for the permitted use, subject to applicable law.

You represent that:

  • You own the submission or have permission to provide it.
  • The submission is accurate to the best of your knowledge.
  • You have disclosed material compensation or incentives connected to the submission.
  • The submission does not violate another person's intellectual-property, privacy, publicity, or other rights.
  • The submission is not unlawful, fraudulent, threatening, defamatory, obscene, malicious, or deceptive.
  • The submission does not contain malware or harmful code.

We may moderate, refuse, remove, or edit submissions that violate these Terms, applicable law, or our content standards.

We are not required to:

  • Keep feedback confidential.
  • Pay for unsolicited feedback.
  • Use submitted feedback.
  • Respond to every submission.

Section 20 — Errors, Inaccuracies, and Omissions

Information appearing through the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to matters such as:

  • Product descriptions.
  • Product images.
  • Pricing.
  • Promotions.
  • Shipping charges.
  • Processing times.
  • Transit times.
  • Product availability.

We may correct errors, update information, or cancel affected orders where permitted by applicable law.

If we cancel a paid order because of an error, we will issue an appropriate refund.

Nothing in this section permits REVIVAL ARMOUR to engage in misleading conduct or avoid obligations imposed by applicable consumer law.

Section 21 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services, directly or indirectly:

  • For an unlawful, fraudulent, deceptive, or malicious purpose.
  • To violate any applicable law, regulation, ordinance, or legal right.
  • To infringe our intellectual property or another party's intellectual property.
  • To harass, threaten, abuse, defame, intimidate, or unlawfully discriminate against another person.
  • To provide materially false or misleading information.
  • To impersonate another person or organization.
  • To use a payment method without authorization.
  • To submit fraudulent orders or refund claims.
  • To distribute spam, chain letters, or unauthorized solicitations.
  • To upload malware, viruses, or destructive code.
  • To interfere with the security or operation of the Services.
  • To bypass technical restrictions.
  • To collect another person's personal information without lawful authority.
  • To scrape, extract, copy, monitor, or harvest data without permission.
  • To reproduce, resell, or exploit a material portion of the Services.
  • To use bots or automated systems in a manner that burdens, damages, or interferes with the Services.
  • To conceal the use of an automated agent where identification is required.
  • To circumvent anti-bot measures, access controls, or rate limits.

We may suspend, restrict, or terminate access when we reasonably believe these Terms have been violated.

Section 22 — Automated Agents

This section applies when you use, allow, or deploy software that takes autonomous or semi-autonomous actions to access or interact with the Services.

An "Agent" includes software, bots, artificial-intelligence agents, automated purchasing tools, crawlers, or services acting on behalf of a person or organization.

An Agent may not access or interact with the Services when:

  • We have requested that the Agent stop.
  • The Agent circumvents access controls.
  • The Agent disguises itself as a human.
  • The Agent attempts to defeat a CAPTCHA.
  • The Agent creates an unreasonable burden on the Services.
  • The Agent violates these Terms or applicable law.

Where technically supported and required by us, an Agent must accurately identify itself through its user-agent information and must not conceal its automated nature.

We may use technical measures to limit or block automated access.

Section 23 — Suspension and Termination

We may suspend or terminate your account or access to all or part of the Services where reasonably necessary, including when:

  • You violate these Terms.
  • Your activity creates a security risk.
  • Your activity causes harm to another person.
  • Fraud or unauthorized activity is suspected.
  • Continued access would violate applicable law.
  • Continued access would expose us or another party to liability.

Termination does not eliminate payment obligations or liabilities that arose before termination.

Provisions that should reasonably continue after termination will survive, including provisions relating to:

  • Intellectual property.
  • Feedback.
  • Privacy.
  • Disclaimers.
  • Limitations of liability.
  • Indemnification.
  • Governing law.
  • Disputes.
  • Amounts owed.

Section 24 — Disclaimer of Warranties

The Services and general information provided through them are offered on an "as is" and "as available" basis to the fullest extent permitted by applicable law.

We do not guarantee that:

  • The Services will always be uninterrupted.
  • The Services will always be error-free.
  • Every product will remain available.
  • Every delivery estimate will be met.
  • Every device will display a product identically.
  • Every third-party service will remain available.

Except for warranties expressly provided by REVIVAL ARMOUR or required by law, we disclaim implied warranties to the fullest extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.

Some jurisdictions do not permit the exclusion of certain warranties.

This section does not exclude or restrict warranties, guarantees, remedies, or consumer rights that cannot legally be excluded or restricted.

Section 25 — Limitation of Liability

To the fullest extent permitted by applicable law, REVIVAL ARMOUR and its owners, officers, employees, contractors, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from:

  • Use of or inability to use the Services.
  • Delayed access to the Services.
  • Reliance on general website content.
  • Unauthorized access caused by circumstances outside our reasonable control.
  • Third-party websites or tools.
  • Lost profits, revenue, data, business opportunities, or goodwill.

To the fullest extent permitted by applicable law, our total liability arising from a particular order will not exceed the amount you actually paid to REVIVAL ARMOUR for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be limited, which may include liability arising from:

  • Fraud.
  • Willful misconduct.
  • Gross negligence where it cannot be limited.
  • Death or personal injury caused by legally actionable negligence.
  • Breach of non-waivable consumer rights.
  • Other liability that applicable law prohibits us from excluding.

Some jurisdictions do not permit certain limitations or exclusions. In those jurisdictions, our liability will be limited only to the maximum extent permitted by law.

Section 26 — Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless REVIVAL ARMOUR, Shopify, and our respective owners, affiliates, officers, employees, contractors, agents, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses resulting from:

  • Your material breach of these Terms.
  • Your unlawful use of the Services.
  • Your violation of another person's rights.
  • Content you submit that infringes another person's rights.
  • Fraudulent activity conducted through your account.
  • Your intentional misconduct.

This section does not require you to indemnify a party for that party's own fraud, willful misconduct, legally actionable negligence, or other conduct for which indemnification cannot lawfully be required.

We will provide reasonable notice of an indemnifiable claim where practical.

You agree to provide reasonable cooperation in defending the claim.

We will not agree to a settlement that imposes non-monetary obligations on you without your consent, which will not be unreasonably withheld.

Section 27 — Non-Waivable Consumer Rights

Nothing in these Terms is intended to exclude, restrict, or modify a right, remedy, guarantee, warranty, or protection that cannot legally be excluded, restricted, or modified.

Where applicable consumer law conflicts with these Terms, the applicable consumer law will control to the extent of the conflict.

This may include rights relating to:

  • Defective products.
  • Misdescribed products.
  • Products that do not conform to the contract.
  • Delivery obligations.
  • Refunds.
  • Returns.
  • Cooling-off or withdrawal periods.
  • Unfair contract terms.
  • Product safety.
  • Privacy.

Any language stating that an action is taken at our discretion remains subject to applicable law and our obligation to act lawfully.

Section 28 — Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

Any unenforceable portion will be treated as severed without affecting the validity of the remaining provisions.

Section 29 — Waiver and Entire Agreement

A failure or delay by REVIVAL ARMOUR in exercising a right under these Terms does not waive that right.

These Terms, together with the policies and rules incorporated by reference, constitute the entire agreement between you and REVIVAL ARMOUR concerning your use of the Services and purchases made through them.

They supersede prior or contemporaneous agreements, representations, communications, and proposals concerning those matters, whether written or oral.

Nothing in this section excludes liability for fraudulent misrepresentation or other liability that cannot legally be excluded.

Section 30 — Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms in connection with:

  • A merger.
  • An acquisition.
  • A restructuring.
  • A financing.
  • A sale of assets.
  • A transfer of our business.

Any assignment will remain subject to applicable law and will not reduce non-waivable customer rights.

Section 31 — Governing Law and Disputes

These Terms and any separate agreement through which we provide Services will be governed by the laws of:

[INSERT THE STATE AND COUNTRY WHERE REVIVAL ARMOUR IS LEGALLY BASED]

This choice of law does not deprive a consumer of mandatory protections provided by the laws of the consumer's place of residence where those protections apply.

Subject to rights that cannot legally be waived, legal proceedings relating to these Terms will be brought in the courts located in:

[INSERT COUNTY, STATE, AND COUNTRY]

Before filing a formal claim, you and REVIVAL ARMOUR agree to make a reasonable good-faith effort to resolve the dispute by contacting the other party and describing:

  • The nature of the dispute.
  • The relevant order.
  • The requested resolution.
  • Supporting information.

This informal-resolution requirement does not prevent either party from requesting urgent legal relief or exercising a right where a deadline would otherwise expire.

Section 32 — Headings

Section headings are included for convenience only and do not limit or change the meaning of these Terms.

Section 33 — Changes to These Terms

You may review the current version of these Terms on this page.

We may update these Terms to reflect changes in:

  • Our business.
  • Our products.
  • Our fulfillment providers.
  • Our Services.
  • Applicable law.
  • Operational practices.
  • Security requirements.

When we update these Terms, we will revise the "Last updated" date.

Where required by law, we will provide additional notice of material changes.

Changes will apply prospectively from the effective date stated in the revised Terms.

Your continued use of the Services after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.

Changes will not retroactively reduce rights attached to an order already accepted unless permitted by law or agreed to by you.
